[UPDATE 3] Marvel vs Fox vs Sony - Solution to All of Their Problems!

Marvel fans have been at war ever since the release of the first Iron Man film. After realizing that Marvel studios knows how to make a great superhero film, fans wanted all of the film rights of Marvel characters back at Marvel studios. I think I came up with a deal Marvel studios can make with Fox and Sony to make it so.

I was sitting around and thinking, what if Marvel got the film rights back to all of their characters?  Who would they use?  What films would they make with them? and that's when something interesting came to my mind. If Marvel studios got the rights back to the X-Men, Fantastic Four, and Spider-Man, I speculate that they'd have little interest in making any of those films, since they are focusing on The Avengers.  What they would want is particular characters, such as Wolverine, Spider-Man, Silver Surfer, and Galactus for The Avengers, Professor X and Mr. Fantastic for the Illuminati, and Norman Osborn and Venom for the Dark Avengers.  It would be a shame to not see a X-Men, Fantastic Four, or Spider-Man film for a while, just so that Marvel can have a handful of characters.

As I continued to sit, I remembered how a few days earlier I watched The Last Stand.  As I thought about it, I wondered how much better it could have been if they had more time.  With fear of the film rights to X-Men and Fantastic Four going back to Marvel Studios, if they wait too long, films like X3 are forced out.  Fox, if put in the situation again will force another X3 out rather than let the rights go back(Daredevil is the exception, but remember they rather let those rights go back than the rights to the Fantastic Four).  Sony was put in a similar situation with The Amazing Spider-Man but in my own opinion, they handle it pretty well, but given more time, They could have done much better.

[UPDATE]  To be clear from what I wrote above, Fox and Sony will NEVER EVER let the rights to their Marvel characters to go back to Marvel studios, so remember that before continuing reading.

All three studios have a problem which could be fixed with one deal.  Marvel should negotiate a new contract with Fox and Sony, allowing them to hold on to the rights of X-men, Fantastic Four, and Spider-Man as long as they like, without fear of the rights going back to them if they don't force a film out in time.  Yes, you read it right, but there is a loop hole, that allows Marvel to use any of the charcters they like, at anytime and for any reason.  With this deal, we won't have to worry about Fox or Sony forcing out potentially bad films, just to keep the rights to their Marvel characters, and Marvel Studios can finally use almost every character they want in future MCU films.

[UPDATE 2] Let's not forget that with the studios sharing the characters, it could potentially bring more popularity to these characters and comicbook films in general.  The more popular these characters become could lead to higher box office numbers from all the studios, which something I thing Marve studios, Fox, and Sony would be interested in, if they could look past their differences.

[UPDATE 3] Sorry if I didn't make it clear, and hopefully this will be my last update, but in this shared deal, it will not effect the already established univeres of Fox and Sony.  If Marvel choose to use any of the characters owned by Fox or Sony, it will be their own version, existing outside of the Fox and Sony universe.  So Fox and Sony can continue making films as they have planned or will plan without Marvel swooping in screwing their universe all up.  In short, they will not be connected.

I don't think Fox and Sony would agree to such a contract. Sure they don't have to worry about the rights reverting, but they have to worry about what Marvel brings to the screen. Also I'd rather have each respective studio focus on what they have, sure I'd like to see a cohesive MCU with all of Marvels character. But as it stand right now, I'm fine with Fox having the rights to the X-Men (although I want to Fantastic Four back) and Sony has a cash cow in their hands so they definitely won't give up Spider-Man.

Seriously, if Marvel had the Fantastic Four would we even get the Guardians of the Galaxy? If anything the loss of these movie rights has forced Marvel into using other heroes or groups for the MCU.

Interesting idea. I don't know all the legal bulljunk involved in these kind of deals, but I'd love for something like this to happen. It'd be awesome to see Spidey as an Avenger or Wolverine. It would help Marvel created an even better universe of heroes.

It's probably all a pipe dream man, but we can still hope, right?

@DeusExSponge....great points! It might be a good thing for Marvel not to have the rights to some of these properties. I'm more excited about seeing Guardians of the Galaxy than I am the Fantastic Four. I really hope the new FF4 is good though. Those last ones....smh...

If Marvel used any of the characters they wanted any time then they could cause more Quicksilver conflicts throughout the universe. Studios definitely don't want other characters they own to appear in other movies, and it's understandable.
While for example, I'd love to see Storm and Black Panther together, it's just not practical both legally and creatively.

The only two properties that I feel need to be back at marvel is Spiderman and the fantastic although I feel that the rights shouldn't have to revert. There could just be a deal between sony(Spiderman), fox(fantastic four) and marvel so that in each of their movies they establish that the character exist in each others universes and have one if crossovers.
This should be similar to the time when oscorp tower nearly showed up in the avengers. I also believe that their is still time to included the latest amazing Spiderman franchise into the mcu. All the would have to do is explain where it fits on the timeline. I thknk it should go:

Iron Man
Iron Man 2
TIH
Thor
The Avengers
Iron Man 3
TASM
Thor The dark world
Captain America TWS

Marvel could also negotiate with fox so that the new fantastic four movie could be in canon.....you never know

Not to sound mean to you guys but I think you guys not getting the point.The X-Men, FF, and spiderman rights are NEVER going back to Marvel; Fox and Sony would rather make mor X3s than let the rights go back. So to those of you just wanting maybe FF back or any of the other ones, it won't happen. This deal though benefits MS, Fox, and Sony so while it still most likely wont happen, its still a good deal.

@cherry Quicksilver was only a big deal because one, its the first time its going to happen in this way, and second, a lot a people felt Fox purposely put him in DoFP to [frick] with Marvel.

What does that even mean? Marvel would like to have the rights back. Sure, they don't need them at the moment, but if they could get them back, they would.

Very interesting thought, this editorial. I think that it could theoretically work out great to have certain characters/stories available for inclusion into the Avengers-verse. I have no real need for full crossovers, but it's unfortunate that there are limitations on even small Easter eggs, etc.

As far as the "time crunch" thing, Fox and Sony both appear to have things planned out well ahead at this point, so I don't see an X3 happening because of anything other than general incompetence, which would still be a problem even if the rights were not fixed to a tight deadline.

I see Sony as being closer to possibly allowing some crossover with Marvel, as their Spider-Man game plan seems very shakey to me. Not that they will surrender their rights, but perhaps they'd share with Marvel Studios in exchange for some "help" of some kind.

And regarding Quicksilver, it does not bother me in the slightest for him to appear in separate franchises, played by different actors. The more the merrier, and may the best version win.

@Corn and if you read the next part you'd realize what I meant by that. I really don't think, with all the characters MS has, and are planning to do, that they'd try and fit a Spidey, FF, and X film in there. Especially an X film, since they don't need a another team since they already have Avengers, Guardians is about to come out and The Defenders Netflix series is in the works. What I speculate they do want is to add some of those characters to future MCU films and/or shows. Like Spidey and Wolverine in the Avengers, Spidey in a Daredevil team-up, Norman and Venom in a Dark Avengers team, etc.

Marvel is fighting Fox. There's a whole big thing about Marvel pulling FF comics and not promoting toy sales and what have you. Walk into Walmart and you trip over a Cap shield or a Spidey Web shooter but there's no wolverine claws. Why? Because in the contracts Marvel controls all the merchandising. I can't explain it well but if you Google marvel vs Fox or marvel canceling FF then you will start to get hits and info. Marvel has a long term plan to slowly strangle the FF until it gets the rights back. The Xmen are just 2 popular and if would take an epically bad movie (Hell the X men survived X3 and Wolverine Origins!) That makes no money to come back to marvel. As it stands now, in the grand scheme, DoFP didn't male a ton ofoney. It was one of the most expensive movies Fox ever made and it will be lucky to hit 700 million. Yes that's a lot of money but when you figure production costs etc etc then you know fox had to be hoping for a higher box office. I love the X men and I would LOVE to see Joss tell his Astonishing story in a movie but it won't happen. I think the FF has a very legitimate chance of coming back to Marvel at some point.

We are better with the rights spread between studios. This past year should be proof of that. Every comic book film has been decent to AMAZING with one more to go that is at the very least going to be interesting to say the least. We would not be having such a great streak of so many films if there was not:

A) Healthy competition forcing each studio to up its game for each movie.

B) They don't want to lose the rights ...so the films BETTER be good so the next in the series doesn't bomb.

Since MOST of the general audience doesn't know what property belongs to which studio ...A LOT of people I know do not even know the difference between Marvel and DC. So, it creates this nice kind of synergy that promotes superhero movies in general. Meaning they don't really have to own the characters ...many probably believe that FF, Spidey and X-Men are connected to the MCU without the tie in. Thus the problem only exists for US.

Now, while I will not go as far as one fellow did to call this dumb ...it is very unrealistic. Movie studios do not have a strong history of working together unless legally obligated. Now while Sony and Marvel have a better relationship than Marvel and Fox or Sony and Fox ...why should they loan their character to help their competitor gain more money off the character they have rights to? It would not be a good business decision for Sony ...and as pointed out above Feige has stated that he is fine with the universe he has. It seems the only rights they want is Fantastic Four ...and I do not think that is for the FF themselves as much as it would be for Silver Surfer, Galactus, and Dr. Doom (I would think that is the most MAJOR name they want). Those characters have strong ties to the Marvel universe as a whole.

@Soto That is why I want this deal to happen, they don't necessarily need these characters but a some point they might want to incorporate them. With this deal, when they decide they want to use these other characters, they can, without taking the rights from Fox and Sony, which would suck, because I wouldn't expect to see another X-film, FF, or Spidey film anytime soon if say they got the rights back today.

I feel Sony would be happy to make this deal, because it would bring more popularity to Spidey. Say MS put Spidey in the Avengers, Spiderman will become more popular, so Sony's solo Spidey films will gain a bigger audience. You are right about Feige being happy with the universe MS has, but he also said, he'd still like the rights to come back at some point.

Again though I doubt if MS got any of the rights back from Fox or Sony that they'd do a Spidey,X-men, or FF film at least not anytime soon. I figured they just use particular character to add to already existing and possible other film consisting of characters they already own, such as the Avengers, Defenders, Dark Avengers, Illuminati, etc.

I agree with Soto. Also, whats to stop Marvel from just doing their own Spidey film? The deal says it can't be a solo flick? Only team ups? To the general audience, Quicksilver doesn't matter. Who is he to them? Now Spidey......everyone knows him. Why would Sony want to put their Spider-Man up against Marvels? Does Sony get a percentage of the profits? Too complicated of a deal. As badly as I want to see all my favorites in the same movie some day, I dont want it the wrong way.

@wylee Again, while there would be nothing stopping them, with all the character MS already have the ones they plan to do, it would be unlikely that they'd do a Spidey solo film. Plus with them already having the MCU planned out till 2020 and with Feige not all to eager to get the rights back, it looks even more unlikely.

Even if they do have two Spidey, X-men, or FF films coming out within months of each other, it potentially could be very beneficial for both studios and cbms altogether.

@Soto Well first, not one hardcore fan or moderate fan of cbms would not watch a CBM by fox or Sony just because it wasn't made by MS(well not any less than it already is). When it come to the general audience they just want to watch a film they think will be entertaining to them and with both studios making a Spidey film or one of the others the general audience will find more interest in the character/team which will heighten the popularity of both films.

So when I say MS can use these characters whenever and for whatever it will not mess with Sony or Fox in any way other than potentially making their Marvel films more popular.

But wouldn't it be weird for these characters to have different actors portraying them on the silver screen? I'm sure the general audience would be confused with various actors being the same characters throughout these cinematic universes. Heck, it would be even worse if some of these actors are replaced throughout their cinematic appearances. Imagine if Spider-Man had two different actors portraying him and suddenly the actor in the MCU is replaced with another actor. It would be a mess and confuse the heck out of the audience!

It would be confusing for the general audience. So this caters to the fans. Just like the books where there's different titles about the same character, but different stories. Like the 616 universe and the Ultimate Universe, or Earth X. You get my meaning. The problem is......the fans make up such a small amount of the box office. So why take the risk......for such a small percentage of people that would be pleased? Yeah anybody would love to see Spidey join the Avengers im sure, but, two different story lines would really confuse the GA.

marvel where very happy for other studios to take these characters and throw millions at them developing them in the publics mind. They should stop complaining. also if marvel had done a good job with those characters in the first place they wouldnt have had to sell to disney or any other studio for that matter

The GA being confused is not going to stop them from watching the films plus it should not take long for them to figure out what's connected and what's not... If they can't figure it out on there own they'd do their research and they choose not too they deserve to be confused.

This is ludicrous. If people honestly believe that Marvel wouldn't make a film of their flagship character, Spider-Man, then those people are criminally insane.

Same can be said about X-Men. F4, okay MAYBE they would hesitate. But Spidey and X-Men? Not a chance in hell.

Feige himself has stated that he would love to get those characters back. Unfortunately it cost a fortune, and ultimately it isn't needed for what they are doing. That doesn't mean Marvel doesn't care about them. It just means it isn't plausible, so why worry about it?

But again, you better believe they would make movies of X-Men and Spidey if those rights reverted back tomorrow.

I did actually write a long comment in response to this article but some reason it didn't post. The X-men can stay with FOX since there finally getting back on track with there films as long as they don't get too carried away as in un necessary films for the X-men universe eg. Mystique and Gambit films. FOX have kept making promises about spin off films and the future of the X-men but have most of the time failed to deliver as in with Deadpool. FOX also announced at the same time that Wolverine Origins was released there would be a Gambit film in development and after that announcement there was nothing to be heard off. FOX can keep there precious X-men because if Marvel had the rights it would not fit in the MCU and it would also slightly confuse the audience as to why super heroes are loved but the X-men are hated unless Marvel does acquire the rights to X-men and keeps the X-men seperate from the MCU.

As for the Fantastic Four still stuck with FOX seems like a huge blow in which the FF would fit perfectly at Marvel and the MCU, the rights to the FF would bring in a whole bunch of cosmic characters. The Skrulls where going to be an enemy in The Avengers video game but the Skrulls are attatched to the Fantastic Four there for there wont be any Skrulls in the MCU. Great villains such as Galactus, Doctor Doom and Annihilus are just to name a few villains which won't be a part of the MCU. I have no faith in FOX's Fantastic Four. The Fantastic Four won't even be referred to as The Fantastic Four. The director and the cast seem like odd choices that don't fit The Fantastic Four. Maybe some day the FF will be brought back to Marvel but as of right now i have a churning feeling in my stomach that FOX's FF could be terrible or worse mediocre and boring.

As for Sony's Spider-man, TASM franchise started off strong and i really enjoyed TASM for what it was even though i had a few problems about the film which can be easily overlooked eg. Crane Scene was laughable. TASM 2 however i blame Sony for being to grubby and forcing there hand over the franchise and squeezing as tightly as they can. TASM 2 was just a train wreck i would put the film up there with Green Lantern as one of the worst comic book films ever made. I also blame the screen writers for the atrocious mess and the world building/shared universe just felt forced and it really did feel as if TASM 2 was trying to cash in on that Avenger's success. It's a tough for me to decide what happens with Spider-man because ever since i was a kid i loved Spider-man, you have the thug that keeps coming back to beat down the franchise and i think personally Spider-man deserves a whole bunch of respect. Spider-man should be brought back to Marvel but have the Studio to take it's time to work on the Spider-man mythos properly and to not release a Spider-man film until after The Avengers 3.
