Marvel And Jack Kirby's Heirs Finally Settle Lengthy Legal Battle

Marvel Entertainment and the family of Jack Kirby have had a long-running legal dispute over the rights to some of Marvel's most popular characters for a number of years now, but it has finally been settled out of court just days before the case was set to be appealed before the Supreme Court. "Marvel and the family of Jack Kirby have amicably resolved their legal disputes, and are looking forward to advancing their shared goal of honoring Mr. Kirby's significant role in Marvel's history," the company and Kirby's family said in a joint statement released today.

Kirby's heirs had been pursuing Marvel over profits relating to characters co-created by the artist and sought to terminate grants of copyrights to the characters, under a clause of the 1976 Copyright Act. However, Marvel contended that they continued to own the characters because Kirby was working "for hire." It's likely that they've been paid a huge sum or promised a cut moving forwards, though it's not quite clear what would have happened if the Kirby family had managed to get their hands on the rights to characters like the Hulk and Fantastic Four. Now, we'll never know...

Something that annoys me is that Kirby's kids probably don't give a single shit about their fathers legacy, they're probably in it for the money. That's why I like celebrities like Jackie Chan who make their children work for their wealth and not expect to get everything they want making them spoilt snobs.

Bill Finger has one heir left and she is childless. The best that family can hope for is proper official co-creator credit, and if no one is left in the family to fight for it....

I wouldn't be surprised if one day in the very far future, Bill Finger does eventually get that co-creator by-line...long after Warner Bros. is convinced that they don't have to pay anyone.

These spoiled heirs don't actually want the rights to all these characters. Every couple years some brilliant creators' grand kids realize they can get rich quick by suing Marvel, DC, etc.
The entire goal is to settle for millions. How the hell does it honor Jack Kirby to pay extortion money to his descendants?

If the goal is actually to give him whats owed, then they should take that money and fund a biopic that celebrates his work and his life so that everyone would know his story.

If the characters had went to the family of Kirby, I'm pretty sure Fox would still own the film rights anyway. I'm not legal expert, but it just seems to me that would put Kirby's family in the same position as Marvel. Not that Kirby's family would even have a clue what to do with these characters anyway.

@OmegaDaGod EXACTLY!!! These guys were artist...and pretty damn good artist..NOT lawyers. And not to mention POOR artist when the game started...They had love for the art and the greed element used legal-ease to hide the butt [frick]. Even Kirby himself said similar things..and they did it to many people in that era
