MARVEL'S THE AVENGERS Briefcase Set To Be Released Spring 2013

Following the legal problems surrounding the release of Marvel's The Avengers in a replica of the briefcase used by Nick Fury in the superhero ensemble, it is now being reported that the set has been pushed back to an unspecified Spring 2013 date. Read on for details!

Entertainment Weekly reports that the "Phase One" briefcase set featuring Marvel's The Avengers, Captain America: The First Avenger, Iron Man, Iron Man 2, The Incredible Hulk and Thor on Blu-ray will now be released on "an unspecified date next spring, according to sources at parent company Disney." Originally set to be released on September 25th, a German luggage firm have filed a lawsuit because of the similarities between the replica briefcase being used for this set and one of their products. The set, which includes a glowing replica of the Tesseract, is now being redesigned. What will happen to the discarded plastic briefcases and what this new version will look like is unknown.

not sure why they couldn't settle with the original suitcase engineers, but at least the suitcase folks keep the integrity of their intellectual property, and rich-as-Croesus Marvel/Disney refute the indignity of having to write that check. they'll probably spending the same amount redesigning and recalling and reproducing.

whatever. mini-toy arguments aside, Disney wanted to squeeze more out of the agreed upon original contract and didn't want to pay.

Disney was already throwing more extras in the regular Blu-ray (four disk set) release than in this box set. You get Disney reward points, one of the five theatrical posters with option to get the other four for a total of $19.99, as well as the ability to cash in your Disney points for free exclusive merchandise.

As far as this briefcase issue goes I am unsure as to why Disney didn't win. First off they were given rights to modify a briefcase from this company and put it in the movie. Under patent law if you give permission to modify a product the then modified version can have a replica made. This German company never released a briefcase with a clear hole in the top featuring a Shield logo. That is enough of a cosmetic difference that this should have been thrown out of court.

I wonder if I'll ever get something I look forward to on the specified day of it's release, nothing ever releases as scheduled. However, if they lose the model Tesseract and the sleek suitcase design, they won't be getting a cent from me.

About distribution before the lawsuit goes to court, I'm still pretty sure the plaintif has to file a request for the offending product to be banned. From there, they have a hearing and a judge decides whether or not the product is allowed to be sold or has to be pulled from shelves. Unless Disney is suspending the production and release of this product voluntarily, this news still doesn't make sense to me. I also don't know why they would do so voluntarily, considering the money they'll lose by delaying and redesigning this product. Unless the actual case is being used in future movies and they don't want to ruffle feathers, I don't understand the reasoning behind this -- unless the lawsuit can't go forward until the actual product is sold and they just want to avoid it altogether? I'm waiting to hear what distributors say about the situation.
