Four Men Finally Indicted For 77 Year Old Comic Collectors Murder!

You may remember the report here at CBM last fall on the death of 77 year old Homer Marciniak. Marciniak was beaten during a break in at his Medina home last July 5th and died later that same day from a heart attack. The target of the break in and subsequent beating was the elderly mans comic book collection. Although arrests were made, at the time of the report nobody had been charged for the death of 77 year old Marciniak.

That situation has now changed.

Rico J. Vendetti, 41, a Rochester businessman, was charged last year with hiring people to break into the home and steal the comics, but a federal grand jury has now indicted Vendetti and three other people for murder, U.S. Attorney William J. Hochul Jr. said this afternoon.

"I think a lot of people in Medina will be very pleased to hear about this," said Medina Police Chief Jose L. Avila, whose department started the investigation. "I know Homer had a bit of a heart problem, but many people in this town believe -- and I agree with them -- that he would not have died that day if not for this incident."

After a lengthy investigation, the grand jury found cause for murder charges against Vendetti and three other Rochester residents, identified by Hochul as Arlene Combs, 26; Albert Parsons, 42; and Donald Griffin, 23.


Hawksblueyes: When I began reading this news, I immediately remembered hearing about this situation last year and felt a small sense of satisfaction that something was being done about it. I thought the CBM community would appreciate the update as well.

I didn't add his wrap sheet to the article because I didn't want it to become all about him but evidently the Vendetti dude has been hiring these thugs to steal quite a few (selected items) in the same manner. He then sells the items on ebay. This was not random. These dudes target both the victims and the merchendise.

Good find Hawks. I got quite disgusted and depressed when I first read about this incident. Glad at least some justice came about. If only this were the Marvel universe...

I think I remember reading about this on here. It's a real shame but hopefully a conviction will bring some sort of relief to his relatives.

He must have had a sweet ass collection... being 77 he might have had the cream of the crop when it came to silver and golden aged comics. Damn shame that someones greed led to him dying. That is foul and damnable.

If someone dies as a result of any felony, it can be automatically upgraded from manslaughter to 1st degree murder, its called the felony-murder doctrine. I hope they fry those assholes.

crosby: What you say is true. The problem in this situation however, is that after the incident Marciniak was checked out at the Hospital, went home, talked to police again and sometime after the police left that afternoon, he had his heart attack. There is something like 12 hours between the incident and the mans death. Were they related? No doubt. The problem was proving it. Evidently, now prosecutors beleive they can. I certainly hope they do.

Hawks: thanks for posting an update to this story. I remember reading about this. I'm glad that the vermin responsible for this has been arrested. Hanging is too good for them. I like Beaverine's idea of beating them to death slowly.

I just hope that the collection can be returned to the Marciniak family, or any part of it that can be recovered.

hopefully their fellow inmates learn they are responsible for causing a 77 year old to die and justice is served out by the other criminals, normally i dont support violence of any kind but being this will be a long shot getting murder charges being he died 12hours later but it seems only justice can be served out in this way

It's nice to know that, every once in a while, the bad guys don't get away scot-free. Justice may have been served, but Vengeance is one hungry mofo....

Wasn't on CBM last year so I didnt hear about the case, that's terrible! How can a person's life be equivelent to any amount of comic books? I hope they rot... in fact, i hope they dont get the death sentence. a life time of torture would be more suitable for such a complete disregard for how precious life really is. RIP, Homer.

I live in Rochester, and this was all over talk radio this morning on my way to work. If they are convicted on all charges, the four face life without parole. I sincerely hope this is one time the judicial system doesn't do one of its usual bungling jobs, and puts these dirtbags away for good.

Awesome. I forgot about this case. I'm really happy they finally can get these guys. I hope things turn out for the Marciniak family. Vendetti is a first class ass[frick] for the shit he's done.

@Hawksblueeyes: The statute of limitations in most states for murder is one year; some states have abolished it all together. This one might be hard to prove, however... Either way, I hope they get em.
