Has Punisher Actor Jon Bernthal Walked Back On His MCU "Nonnegotiable" For SPIDER-MAN: BRAND NEW DAY Role?

Following the news that Daredevil: Born Again star Jon Bernthal will return as The Punisher in Spider-Man: Brand New Day, it sounds like the actor might have had to change his one MCU "nonnegotiable."

It was back in January when The Hot Mic's John Rocha claimed that the then-untitled Spider-Man 4 would see Tom Holland's Peter Parker team up with Jon Bernthal's Punisher to do battle with The Hulk. 

The rumour was hard to believe, but then the ones that frequently come true often are when we first hear them!

Yesterday evening, the trades confirmed that Bernthal has been tapped to star in Spider-Man: Brand New Day, and while the Jade Giant's return remains unconfirmed, the movie is shaping up to be very different from what we expected. 

Bernthal's Punisher made his MCU debut in Daredevil: Born Again after previously playing the character in Netflix's Daredevil and two seasons of his own spin-off series. His return was celebrated by fans, and over the years, the actor has become synonymous with the role.

In the Man Without Fear's Disney+ show, Frank Castle brutally killed members of Mayor Fisk's Anti-Vigilante Task Force and was ultimately captured by them. A post-credits scene teased his escape, and while a "Special Presentation" is on the way, how can the R-Rated killer fit into a PG-13 movie?

That's a question for another day, but The Hollywood Reporter has included an interesting tidbit in its piece confirming Bernthal's Spider-Man: Brand New Day role.

"Curiously, one nonnegotiable he had for his return to Daredevil was maintaining the character’s violent, R-rated feel," the trade writes. "It will be interesting to see how that translates into the more kid-friendly tone of the Spider-Man movies."

It's a valid point, but Spider-Man: No Way Home saw Aunt May die at the hands of the Green Goblin, and Peter has gotten pretty bloodied in each of his MCU solo outings, so it's not like the PG-13 franchise is that kid-friendly.

While Bernthal has seemingly walked back on his "one nonnegotiable," it's hard to blame him when it means bringing The Punisher back to the big screen alongside an actor, Holland, whom he helped land the role of Spider-Man.

We definitely don't anticipate seeing anything as violent as Daredevil: Born Again, and how will Spider-Man feel about working with a vigilante who murders the criminals he encounters? Spidey doesn't kill, but he came close after fighting Norman Osborn. And will Daredevil at least show up in a cameo role? Here's hoping.

Spider-Man: Brand New Day shares a title with a controversial era of storytelling, which saw Marvel Comics give the wall-crawler a fresh start by ending his marriage to Mary Jane Watson and making his identity secret again. He faced many new sinister foes during that time and was surrounded by an overhauled supporting cast, including a resurrected Harry Osborn.

Mister Negative, Jackpot, Menace, and Carlie Cooper were some of the standout additions to his world, and are among the most likely possibilities to make an appearance next summer. You can learn more about how "Brand New Day" may influence the next Spider-Man movie here

Shang-Chi and the Legend of the Ten Rings helmer Destin Daniel Cretton directs Spider-Man: Brand New Day from a script by Chris McKenna and Erik Sommers. Tom Holland leads a cast that also includes Zendaya, Sadie Sink, and Liza Colón-Zayas.

Spider-Man: Brand New Day will be released in theaters on July 31, 2026.

Yeah , I’m curious about that aswell unless they do lean into Franks violent nature in service of the story (maybe still not as much as the shows but moreso then we think)…

After the events of NWH , I can see Peter as time and distance have grown that he has perhaps become more isolated and even angry due to having lost his friends and Aunt May (perhaps even checks up on MJ and Ned possibly regretting his decision to stay away from them) and that’s when Frank comes in who is filled with pain and loss aswell as he goads Peter into giving in because it’s the only right way to deal with these criminals or could even try to dissuade Peter from heading down the same route as him due to maybe finding out he’s still a “kid” etc.

There are certainly dramatic avenues they can go so I hope DDC & his team capitalize on that.

The check will make him walk it back for now. There are ways to sell his brutality even in a PG13 method. Obviously won’t be as visceral as the tv side but some creativity can help make up for it.

Shouldn't be too hard really. They can show the aftermath, or imply brutality. The pencil trick from Dark Knight, Bane crushing Dagget's head in Rises, the decapitation in Doctor Strange, the imploding head in Multiverse of Madness, the execution of Taskmaster in Thunderbolts... These are all 12A/PG-13 movies. Most of them are in the same universe. There are countless others in the "family-friendly" category- look at Indiana Jones.

@KingZero - Yup, a lot of the time it only requires reducing blood splatter or ONLY seeing the blood pooling whilst avoiding showing the fatal blow that causes it so ample ways the tone of the character can work within a 12A/PG-13 without it slipping into the 15 category in the UK (which would be R in the US).

@KingZero - I mean, Anakin cut off Count Dooku's head in Episode 3 and we literally saw it rolling around on the ground. (It was an awesome scene and great camera work to manage not to look silly)

But my point is I tend to agree with you. Violence doesnt have to show blood and gore. It can be shown and even implied in other ways.

They're gonna remove the skull by the end of Daredevil season 2 and he'll be the ninja with the less offensive logo by the time he shows up in Spider-man.

@HashTagSwagg - Nah. The Punisher is back to having the skull in the comics too. And as it is they hardly ever have him wear the [frick]ing skull in the show either, which sucks.

The Punisher has shown up in TONS of great crossover stories, especially with Spider-Man, that don't come close to the ultra-violence in his own books. Not a problem. Hopefully once they show that it's about the character not the violence they can do the same with Deadpool and have him start popping up everywhere. bUt If hE CaN't sAy baD wORdS hE'S NoT dEadPOoL--

Ryan Reynolds' unnecessary strings of profanity and eye-rolling sex jokes distract from what have otherwise been some pretty-good-to-great stories. Let him be crass, bring on the comedic violence, break that 4th wall all the day long, but Deadpool & Wolverine is almost down there with Love & Thunder as a movie with a great story overshadowed by ineffective 12-year-old humor, but it at least got the story across. Love & Thunder just took a beautiful story and made a joke out of literally EVERYTHING. Never felt so uncomfortable in a movie theater in my life and I took my grandmother to see 50 Shades of Grey.

@bobevanz - Punisher IS one of the characters that killed the Hulk in the comics, in terms of non-super powered ones Hawkeye is another so there are ways it can work esp when Hulk has not been a villain in the true sense in the MCU even whilst having battled with Iron Man and Thor at times.

All that said the list of rumors on who he will fight and/or what other MCU characters will appear is so long it is impossible to take any of them too seriously yet.

Seems his “non-negotiable” comment referred only to him coming to DD. Doesn’t mean anything about him doing a Spider-Man movie. I’m still skeptical about all this happening as a team up or big role, trades or no.

I'm not sure what people are worried about. Punisher's first appearance was literally in a Spider-Man issue. And he's made just as many appearances in less violent comics than he has his own comics. They can still show the violence, just not the excessive blood and gore.
