He deserves the award, he did an amazing job as Caesar. If Heath Ledger can win an Oscar for playing Joker...

To me this would like when Halle Berry won for Monsters Ball when she had better performances in tons of other movies. Same for when Denzel won for Training Day or when Kobe finally got MVP. It's a backhanded compliment to Andy based on prior performances.

To be honest he should get it. I got chills watching that movie. If I had to choose between apes taking over, or terminators... I'd pick apes because at least they would show us mercy. :P

make the case, if you want, that the "performance" of a cg monkey moved you to tears, but isn't the truth just that we want to see this happen as a big FU to the pretentious, seemingly rigged award show and soulless Hollywood?
let's get real there were more moving performances this year, but if you want to content the previous point still, maybe you deserve the award.

He REALLY deserved it for Lord of the Rings, but for this? PASS. Where's his Oscar consideration for playing King Kong?

He desrves it. It's time the academy changed, did you know Tron wasn't eligible for a special effects oscar, despite its groundbreaking work at the time, because using CGI was considered "cheating." I think it's time actors are recognised for their performance, is CGI any different from acting under prosthetics or makeup?

The time is now?
No, the time was back with The Lord of the Rings trilogy. Time for Serkis to be nominated? Perhaps, but definitely time to recognise that a good performance, an Oscar worthy performance, need not stick to the "traditional" methods. That should no longer be a sticking point at all.

A CGI heavy performance should not be weighted any less because of that fact. In fact one could argue (in case by case examples) that working 'through' the limitations of CGI, prosthetics etc. only makes the resulting performance more worthy of note. And these awards are meant to be about recognising the craft, not just what one likes best on film, therefore including 'behind the scenes' considerations as well.

Shouldn't it be the lead actor Oscar? He was the main lead ! And yeah, 100% agree- he deserves it.

Andy Serkis ain't sh!t without a good special effects team. He really is just a digital mime in Planet of the Apes. Mimes are the mute cousins of clowns which have no souls and therefor are undeserving of an Oscar.

He's done excellent films without motion capture, but they are usually smaller British films, he always gets asked to do this work because he is the best at it.

You know, he really deserves best actor, but best supporting actor is good too. Seriously, Ceasar was the main [frick]ing character in the movie.

I know that comment wasn't addressed to me, but I still feel the need to chime in. I've seen all those films. Brando's performance is probably even with Heaths, Pacino is good but not on the same level, DeNiro is probably also even with Heath, Hopkins performance is incredible but the tongue/hissing thing always seems silly to me, shawshank is a great film with a great cast but not any one fantastic stand out performance, Forest Gump is overrated, Green Mile is another great all around with fantastic acting from all but none of these performances match the raw complete psychosis that Heath captured with the Joker. Something like that is hard to do without coming off as over the top. People write off Heath's performance now because its a cliche to think its outstanding, but his performance was one of the best I've ever seen.

Also Serkis deserves at least a nomination.

about time Serkis gets the credit he deserves.

I don't want to get into a flame war here, but its unfair to judge Heath based on the fact that he didn't give enough performances. He died. Al Pacino and Robert DeNiro are, overall, far superior actors to Heath(judging by the films I've seen of Heath, again maybe if he had lived he would have a higher status) but I'm only judging those single performances, not their entire careers. De Niro's performances in Raging Bull, Taxi Driver, and Cape Fear all surpass the Joker performance BY FAR, but the Godfather performance is probably the same level as Joker. Heath wasn't a better actor than De Niro or Pacino, his performance as the Joker just beats out the performances in the movies you listed(for the most part). If it sounded like I was saying he was a better actor overall than I'm sorry, that was not my intention. Of course I still think the Joker performance is as good as everyone says it is and completely deserving of an academy award. Also I'm not really a Nolan fan, just a Dark Knight fan, and I actually like the Godfather films(I refuse to acknowledge the third so I won't call it a trilogy) more than I like the Dark Knight.

@ Talontd NOPE. Always felt that way about Ms. Berry and Mr. Washington.
