SPECULATION: Spidey is now free to rejoin the Marvel film Universe!

People have been complaining about the inability of Spiderman to appear in Disney/Marvel films since the release of Avengers. Miles Morales = PROBLEM SOLVED.

Sony’s option is on the original Peter Parker Spiderman Universe and all the books contained therein.(maybe not all) The fact that Peter Parker is dead and probably Dr. Oct will be too shortly and all of those books are no longer actively being published these actions legally will divorce the two Spiderman properties leaving the Miles Morales Spiderman Universe and probably time traveling of that character fill-in past team-ups (if Disney wanted to) and there’s absolutely no way to confuse Miles Morales with Peter Parker (which would be a large part of the legal standard for infringement)

…It’s BRILLIANT from a business and creative standpoint for the ongoing development of the character without continuing to add to Sony’s Spiderman chest for films and for giving Disney back the film rights they always should have had to a core Marvel character. Had they just made Parker’s replacement another White guy with similar character attributes it would have made for slippery slope legally.

For the people that want to basically disregard the Ultimates version Spiderman as a non main continuity character consider where the Ultimate Nick Fury started and where he is now.

As far as I know, Sony owns the rights to ANY Spider-Man character (even Kingpin, despite his being more well-known as a Daredevil villain). I'd expect Miles to be among those characters. Besides, I personally have little interest in seeing a non-Peter Parker Spidey on the big screen.

Well if Sony doesn't have rights to Miles Morales, than Marvel should make Young Avengers-film with Miles as a team member.

Miles was created after Sony got the movie rights, and technically he is in a different universe than the Peter Parker Spider-Man. (Sorry if I'm wrong still a bit new to comics.) So technically can't they use him AND call him Spider-Man. I'd be completely okay with that.

We just had a film that was very much inspired by "Ultimate Spider-Man," and are getting a sequel that uses an "Ultimate" design for it's main villain, Electro.

So, WHY do you seem to think Sony doesn't own the rights to Miles Morales, a character introduced in a comic that Sony clearly has the rights to base its films on?

And for the record, Fox and Sony have the rights to use any characters created for their respective comic franchises, from both before and after the contracts were signed.

For example: Characters like Darwin, Angel Salvatore, and Azazel were created in the mid 2000's, well after the first X-Men film, but all appeared in First Class.

Marvel can probably use a character like Miles, but not make him anything like Spider-Man. Still, I'd rather see good ole Pete in the MCU.

Sort of reminds me of the old dueling Bonds, Warner Bros. Never Say Never Again vs. MGM's Octopussy.

This wouldn't work. And even if this loophole was legal, I can't see Marvel introducing Miles into the MCU instead of Peter.

Disney practically prints their own money. If they really wanted the X-Men, FF and Spidey back that badly, they'd have bought Fox and Sony out.

The thing is, people who make money off these movies don't care who's in the suit - they care about the suit itself. A character wearing a Spider-Man suit IS Spider-Man, toys made from the movie won't advertise Miles, they advertise Spider-Man.

Sony wants that money. Sony has the rights to all Spider-Man characters, they're not going to let one go because it's a different person.

Yeah funny thing about rights to a character, he is owned by one company regardless of who is under the mask and nobody gives a shit about miles. So glad you decided to write an article on this ingenius idea of yours!

Sony have the rights to the name 'Spider-Man' as well as the features of the character (powers, costume, logo, etc.) in the movies. That means, for a character like Miles Morales to work in Marvel's movies, he couldn't be called 'Spider-Man', he can't have the same powers or webshooters or the same origin, and his costume would have to be completely changed as it's still similar to the original. By that time, there'd be no point at all, and to most people it would seem like Marvel was just ripping off Spider-Man.

I'm still hopeful that Sony and Marvel are continuing to consider The Amazing Spider-Man as a potential part of the MCU.

"Ultimates: Spiderman" and "Ultimate Comics Spiderman" are legally two different entities. As I said with Peter Parker dead and an official punctuation to that Universe and it's characters Marvel's obligations to Sony are likely fulfilled.

I'm sure option contracts are much more piece meal that some of you are trying to describe them as. Ultimate Nick Fury was in "Ultimates: Spiderman" pretty regularly and Marvel clearly owns Ultimate Nick Fury.

I thought the name "Spider-Man" was owned by Sony. So even if they did make a movie about Miles Morales, they would have to completely change everything that the original Spider-Man had (costume, power's, etc). I would just hope that Sony/Marvel join forces and add The Amazing Spider-Man movie franchise to the rest of the MCU!

I doubt it...I mean there are a lot of people that have claimed Sony owns the film rights to everything that's appeared on the pages of any comic past, present and future with the word "Spider-Man" in it and that's not true. Thor was in the Ultimate Spider-Man series (which Sony hold option rights for) and Marvel clearly owns Thor. Marvel also owns all merchandising rights to anything related to the Spider-Man film and Spider-Man comics franchises.

It's like the KingPin situation, I'm sure Sony had to negotiate for every character and comic line they wanted access to and everything has conditions. I'm fairly certain there's a stipulation that requires Sony to release option rights to the character Kingpin to any company legally holding the option rights to Daredevil like they had to with the DD movie from Fox. Sony wouldn't have loaned Fox the film rights to Kingpin if they weren't legally forced to that's just how large corporations are. Now that Marvel owns Daredevil again they'll probably be on the same legal footing as Fox to get Kingpin if or when they decide to make a Daredevil film.

All this chatter about Sony having carte blanche film rights to anything that says "Spider-Man" is far too obtuse to actually be the real situation and inconsistent with the piece meal rights scenarios that are already out there.

Good idea but no. Peter Parker IS Spiderman. Apart from comic fans no one would even know who Miles is.Cool character but it would be too confusing for casual folk

Except the Spider on a red and blue suit... And the alias Spider-Man. Peter Parker may be trapped by Sony, but so is his alias. Miles Morales would have to be Spiderman. And in a very different outfit - perhaps Stark's gold and red Civil War uniform. Miles Morales is not a scientist, and all the equipment comes from Stark. Then, maybe it'll work... But what an epic fail of an idea. Marvel needs Spider-Man and Peter Parker, and not Miles Morales and whatever Spider-Man they can invent without copying the blue and red friendly neighborhood spider-like hero.
