Does Marvel have the film rights to Spider-Man? Possible AOU spoilers

Possible spoilers for the Avengers: Age of Ultron! I may have found possible evidence pointing towards Disney getting back the rights to Marvels most popular character.

After hearing about the Fox lockout that Marvel is supposedly doing with the Fantastic Four comics, I went back and did some more reading about the possible situation and I noticed this picture right here that was released the same day or within a few days of hearing about the lockout:

This is a picture of all the Disney owned Marvel franchises. None of the Fantastic Four or Xmen are in this picture. But if Disney was just concerned about their properties then why would Spider-Man be front and center? I didn't think much of it until I came across this image below a few days ago:

Now to the left of Aaron Taylor Johnson see a person in a hooded jacked with red gloves and a red mask around their neck.


Now there is no doubt that that is Andrew Garfield and that he is definitely in Spider-Man costume. Now with him on the set of the Avengers, this would fall in line with reports that Sony was considering selling the rights to the character if the Amazing Spider-Man 2 underperformed. It definitely wasn't a failure, but it was the weakest performing Spider-Man movie to date. Along with that, Andrew recently had his contracted extended to 2020. Plus the Amazing Spider-Man 3 was pushed back to 2017, a year that Marvel/Disney doesn't have any films as of yet slated for release and would be the best time to put him into his own solo film under their own house. Putting him in the Avengers 2 makes the most sense to get him out there and show Disney has control of him but how they will explain where he was during the first Avengers movie has yet to be seen obviously. Sound off in the comments below and let me know what you think. Does Disney own Spider-Man? Are the two studios working together? Or was just some elaborate ruse to get the newsites talking about the movie and boost ticket sales on opening day?

Also the entire body looks more out of focus and lit differently then the rest of the bodies. Also knowing Hollywood today something like this would never stay quiet this would have broken out immediately. Samuel L. Jackson was brought in secret to Iron Man and driven on set in a limo to try to keep it a secret it was leaked he was Nick Fury that day.

The picture is for sure fake. Seven Webheads posted the original pics together a while back. And as for the 75th anniversary pic, Marvel Comics/Disney still owns the comic rights to spiderman. But they also own the "live action" rights as well (they are separate), so Disney/Marvel CAN use spiderman in live action media, such as television, Internet series, one-shots and shorts. But just not major motion pictures.

If this is legit than, I will tear up if it really happens. We do know that OSCORP tower nearly made it in Avengers Assemble. I am talking about Avengers, just think Avengers Assemble should be the title of the film here in the states too.
