In an interesting interview about Captain America: Super Soldier (the full version of which you can find by clicking on the link at the bottom of the page) comic book writer Christos Gage was asked about who else fans should expect to see turn up and revealed the following intriguing piece of information.



"They’re not necessarily going to be who you expect, like for instance we can’t use Human Torch because he’s part of the Fantastic Four, which is licensed to Fox. I can’t say who because that’s me giving away movie secrets. I have read the script, but I signed an NDA, and if I say the wrong thing the black helicopters come in!


It's fair to assume that if licensing issues mean that the Invader isnt allowed to appear in the video game, the same rule applies for the upcoming live action movie! I'm a little surprised by this as the Human Torch of the Fantastic Four and the android John Hammond from WWII share nothing other than the same name and similar look.

Regardless, Fox clearly hold the right to both the characters name and look, so along with Namor, it looks like the Human Torch is yet another Invader who wont be a part of Captain America: The First Avenger. We know Bucky and Union Jack will feature alongside Steve Rogers, but what of Spitfire and the also fiery Toro? Be sure to share your thoughts in the usual place!

I guess that makes sense. However, I think they could have gotten away with it, since the Human Torch of the 40's and the one currently are two different people.

They can always re-name the guy, remember marvel use to have Carter Slade as The Ghost Rider and they Renamed him. They could call this guy American Torch or the Human Flame or just Torch. And they can always avoid being sued by fox because they have proof this is inspired by an Original Marvel Character. Not one owned by FOX

"Human Torch" as in the name is under license.. and due to the characters being so similar.. and in any case he wouldnt fit in the movie cus he's a frikkin flaming android!!!

And Namor wont be there cus a he's either under the same license as Fantastic Four (or less likely X-Men) and the guy fly with the aid of frikkin mini wing on his ankles!!!

Thanks guys! :) I'm not in the least bit surprised that we wont see the character in this movie...the similarities to the FF version are too much for Fox to allow regardless of the different origin and name. It's a pity, but good in some ways, as a character like John Hammond would steal the spotlight from Captain America and Bucky. IMO, the focus should be on the 100%.

Intruder: I believe that Ed Gross was told by Joe Johnston himself that Namor wouldnt be in the movie, I'm afraid bud! I'll see if I can find the link for you.

marvel studios is making a mistake not including the original human torch,it would of been a great link to the avengers 2 where they could of introduced the vision.

I wanted to see Namor. I guess I'll have to wait a while to see how Namor eventually gets introduced to this Marvel Film Universe.

i think it is a good thing... cause non comic book fans will get confused. you know, seeing chris evans as cap. and having someone by the name of human torch that is not chris evans from FF4... would confuse those who are not loyal comic book fans. just saying.

No, Fox doesn't own the rights to Namor.Kevin Feige already stated at last year's ComicCon that even though Fox owns the film rights to Fantastic Four, Mravel still has the rights to affiliated characters such as Namor, the Inhumans and the Skrulls.

No big shocker there. I saw this coming. No Union Jack, no Sub Mariner, no Human Torch
Of course I am disappointed. I mean how can they even call this the Invaders?

I doubt it will ruin the movie or anything, but it's unfortunate. I think the image of Cap in command of a bunch of guys that are more powerful than he is could have been an important set up for Avengers. C'est la vie

They could have just called him Jim Hammond, but w/e. I didn't expect to see him. I just want Union Jack and Namor.

Actually, this makes no sense.

I just remembered Kevin Fiege in a past article actually mentions the opposite.

That although he had no idea if they would use him in the Cap movie, but went on to say Marvel did indeed hold the rights to the Android Torch...

Marvel does own the World War II Human Torch rights, but can't use him, because FOX decided it would be too confusing for the casual fan to tell the difference between Johnny Storm and Jim Hammond. The Human Torch is still likely to have a nod his way in some form even if it isn't in the script. It is also very unlikely that Namor will appear physically, but I do expect maybe some enemy comments about him or a S.H.I.E.L.D. file on him to appear. It is probable that the Invaders will be Cap, Bucky, Peggy Carter, Patriot, Union Jack, Spitfire, and the Golden Girl.

i remember him saying they hold the rights too Human Torch but it does not mean his going to use the character. it will get confusing if in Captain America movie they use Human Torch and in the F4 reboot they use Human Torch lol.

Plus he deserves his own movie.. Brian "Captain Britian" Braddock's farther got killed during the war and was replaced by another dimensional version that fathered Brain, Betsy "Psyloke" and Jamie

Yeah, I think we can be pretty darn sure that Torch won't be in the film, and maybe because he's not in it, Gage assumes it’s because of Fox (I can see that as a logical guess), although it may simply be that Marvel chose not to go that route.

Either way, regarding the Android Torch’s rights itself, either Gage is right or Feige is, and since this is more Fiege's area, I'm going with him.

Personally, I'd love to see Marvel make a Band of Brothers type of TV show featuring the Invaders. Give Chris Evans and Sebastian Stan a brief cameo but spend 12 episodes focusing on the team. In Captain America: The First Avenger, the focus should be on Cap and Bucky though IMO.
